What This Skill Does#

Generates legally-compliant, conversion-optimized marketing content for asphalt sealing and driveway maintenance contractors. Every output enforces 7 compliance gates that block the most common (and most costly) violations in sealing contractor marketing — including the coal tar PAH gate that most contractors have never heard of until they face a lawsuit.

---

The Problem#

Driveway sealing is one of the most marketing-mistake-prone trades in home services. "Coal tar sealer is the best, professional-grade formula" — that claim alone can trigger Prop 65 liability exposure for California-adjacent contractors, HOA enforcement actions, and EPA storm drain violation referrals in Clark County. "No permits needed" blocks every municipality that requires encroachment permits for sidewalk-adjacent work. "Eco-friendly and safe" on a coal tar product is an FTC Green Guides violation.

Zero competing marketing tools enforce any of these gates.

7 Compliance Gates#

Gate 1 — Coal Tar Sealer / PAH Gate [ANCHOR MOAT]#

Coal tar-based sealers contain polycyclic aromatic hydrocarbons (PAHs) at concentrations 1,000–100,000× higher than asphalt emulsion sealers. PAHs are Prop 65 carcinogens (California) and known human health risks under EPA research (USGS 2005–2013 studies). Banned or restricted in: Austin TX, Washington DC, Minnesota statewide, New York, Maine, Maryland. Clark County storm water program (SNHD) actively monitors PAH runoff into Las Vegas Wash.

Blocked claims:

• "Coal tar sealer is the best / most durable / professional-grade" — without Prop 65 disclosure in CA-adjacent marketing
• "Safe for children and pets after drying" — false for coal tar products (PAH off-gassing continues)
• Any "eco-friendly" or "environmentally safe" claim on coal tar products — FTC Green Guides §260.4 violation

Required disclosure: Asphalt emulsion sealers (AE) must be specified and contrasted with coal tar as a selling point in Nevada/California markets.

Gate 2 — Clark County Storm Water / SNHD Gate#

Sealing work adjacent to curbs, gutters, or storm drains requires SNHD Storm Water Pollution Prevention Plan (SWPPP) compliance. Sealer overspray into storm drains = Clean Water Act Section 402 (NPDES) violation. Clark County Code §30.88 prohibits discharge of sealer residue into the MS4 system.

Blocked claims:

• "We seal right to the curb edge" — without storm drain protection disclosure
• "Same-day service, no prep work needed" — SWPPP prep is required for curb-adjacent work
• "Fast, clean, no mess" — if overspray protection is not disclosed

Gate 3 — Nevada Contractor Licensing Gate (NRS 624)#

Asphalt sealing in Nevada requires either:

• C-5 (Painting and Decorating) — for sealing as a surface coating application, OR
• C-10 (Landscaping) if incidental to landscaping work under $1,000, OR
• General contractor license (B-2) for projects exceeding $1,000

Unlicensed sealing work over $1,000 (materials + labor) = NRS 624.700 criminal misdemeanor (first offense) or gross misdemeanor (repeat). "Licensed and insured" without license type and number = FTC 2023 guidance violation.

Blocked claims:

• "Fully licensed" without license classification + number
• "No job too small or too large" — the $1,000 NRS 624 threshold applies
• "Any crew member can handle it" — only licensee or supervised employee may perform work

Gate 4 — HOA / CC&R Sealing Gate#

In Las Vegas, 70%+ of residential properties are in HOAs. HOA CC&Rs in planned communities (Summerlin, Henderson master-planned communities, Green Valley) frequently:

• Require HOA approval for driveway sealing projects
• Restrict sealer color (black-only vs. decorative patterns)
• Prohibit weekend/evening work (noise ordinances + HOA rules)
• Require contractor insurance certificates filed with HOA management

Blocked claims:

• "We can start this weekend" — without HOA approval disclosure
• "Decorative stamped patterns available in all HOA communities" — false for restricted HOAs
• "No HOA approvals needed for routine maintenance" — false in many planned communities

Gate 5 — FTC Green Guides / Environmental Claims Gate#

FTC Green Guides (16 CFR Part 260) require that environmental claims be:

• Specific (not vague)
• Substantiated
• Not misleading

Blocked claims:

• "Eco-friendly sealing" on coal tar products — unsubstantiated and potentially false
• "Water-based and safe" — water-based ≠ non-toxic; requires full disclosure
• "Green certified" — must cite actual certification (EPA Safer Choice, etc.)
• "Reduces your carbon footprint" — unsubstantiated for sealing services

Gate 6 — Lead Time / Weather Guarantee Gate#

Sealing requires specific temperature and weather windows:

• Minimum surface temperature: 50°F and rising (most manufacturer specs)
• No application if rain forecast within 24–48 hours
• Las Vegas summer temperatures (120°F+ surface temps) can cause premature sealer failure

Blocked claims:

• "We can seal anytime, year-round" — false for extreme summer heat windows and winter cold
• "Guaranteed results regardless of weather" — void on manufacturer warranty
• "24-hour cure time" — most products require 48–72 hours, traffic restriction varies by product

Gate 7 — Warranty / Longevity Claims Gate#

FTC Act Section 5 (unfair or deceptive acts) and Nevada Deceptive Trade Practices Act (NRS 598) govern warranty claims:

Blocked claims:

• "Lasts 10 years guaranteed" — industry standard is 2–5 years; 10-year claims trigger NRS 598 exposure
• "Never needs re-sealing" — false; sealing is a maintenance service requiring periodic renewal
• "Better than any other product on the market" — requires substantiation
